Terms of Service for Marghdeen Online Courses
Our online courses are conducted on the Membership Website. By registering for a Marghdeen Online Course and using the Membership Website, you agree to comply with the terms, conditions, policies and notices stated here. If you do not agree to all the terms and conditions of this agreement, then you may not access the Membership Website or participate in the Online Course.
A breach or violation of any of the Terms will result in an immediate termination of your registration.
We reserve the right to update, change or replace any part of these terms and the privacy policy by posting updates and/or changes to our website. Your continued use of or access to the Membership Website or participation in the Online Course following the posting of any changes constitutes acceptance of those changes.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
User Age and Eligibility
Participation in the Membership Site and Marghdeen Online Courses is restricted to those individuals who: (a) have registered; (b) who are 18 years of age and over, emancipated minors, or those who possess parental or legal guardian consent, and who are fully able and competent to enter into these terms, conditions, obligations, affirmations, representations and warranties herein; and (d) meet the eligibility requirements (if any) of the specific course for which they are registering.
Course Registration
You agree to provide current, complete and accurate information for registering to the Marghdeen Course(s). You agree to promptly update such information, including your email address.
You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to refuse access to the selected course or to terminate your use of the Membership Site.
We reserve the right to refuse any registration you place with us. In the event that we do so, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the registration was made.
You agree that you will not share access to the Membership Site with any third party for any reason.
Modification or Cancellation
We reserve the right at any time to modify or discontinue the Membership Website (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, suspension or discontinuance of the Membership Website.
We reserve the right to correct errors or omissions in the Membership Site, including the course materials, without prior notice. We also reserve the right to cancel, discontinue, reschedule, delay, change instructors or modify any course or service – although we shall not do this unreasonably. You acknowledge that the course content of the online course does not reflect the complete curriculum of a course that may be offered to students enrolled at Marghdeen.
Rules for Online Conduct
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Membership Website, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Membership Website, use of the Membership Website, or access to the Membership Website or any contact on the website through which the service is provided, without express written permission by us.
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate others; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Membership Website or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Membership Website or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Membership Website or any related website or your participation in the online course for violating any of the prohibited uses.
Content Disclaimer
Membership Sites may also include the personal opinions and other expressions posted by other members. Marghdeen is not a publisher of any of that content, or of any content that may be available through links to and from them.
We may provide you with access to third-party tools over which we do not monitor, or have any control, or input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
Third-party links on the Membership Website may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
User Content
By submitting any material in connection with a Marghdeen Online Course, you grant Marghdeen an irrevocable, nonexclusive, royalty free, fully transferable, worldwide license to use, disclose, reproduce, distribute, prepare derivative works of, publicly perform, publicly display and provide to others any such submission.
You hereby grant other participants in your online course a license to use content submitted by in the course (including the right to copy, modify and distribute such content) in conjunction with their participation in the course.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
User Status and Statement of Accomplishment
Subject to satisfactory performance and course completion, you may receive a soft copy of statement of accomplishment. We reserve the right to determine whether a certificate will be issued for the online course and the nature of the information to be provided in it.
You agree that Marghdeen is not required to participate in any attempts to get the course recognized by any educational or accredited institution.
Disclaimer of Warranties and indemnification
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Marghdeen, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
You agree to indemnify, defend and hold harmless Marghdeen and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Privacy Policy
For the purpose of registering into a Marghdeen Course, you we will collect the personal information you give us such as your name, address and email address. We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
We are not responsible for any information collected by third parties, such as Blogger, which will be subject to the Privacy Policy of those parties.
Please note that we shall never ask for sensitive information such as your passwords, etc. Our payments are collected either through the button provided to us by Paypal or through the bank account mentioned on the registration pages for the Online Courses.
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies.
When you click on links on our site, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
Once you leave our site, or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed or disclosed.
Protecting Children’s Privacy
Marghdeen does not knowingly collect or maintain personally identifiable information on our Membership Site from persons under 13 years of age. If you are under 13 years of age, then please do not use or access the Membership Site at any time or in any manner.
Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
